LICENCE FOR PRE-WRITTEN AND TAILORED SOFTWARE
The licence accompanying the software entitles the end user to
use the stated software title only on the number of computers
specified in the licence.
It will also state if it has or has not been written to be used
across a network.
By breaking the seal on the enclosed software package, or by
downloading and installing the software, you will be deemed to
have read our End User Licence Agreement, whether you have
actually done so or not, and therefore you are legally bound to
follow the rules stated in our End User Licence Agreement.
If you do not want to comply with our End User Licence
Agreement, then you must not use our software.
END USER LICENCE AGREEMENT (EULA) (PRE-WRITTEN AND TAILORED
SOFTWARE)
This Agreement is the legal contract between you, the end user,
and us, Swift Software Solutions (SSS). Within this EULA,
we/us/our means Swift Software Solutions, you/your means the end
user. All references to singular will also mean the plural, and
vice versa, and all references to the masculine gender will also
mean the feminine gender and vice versa. Computer means any
device that is capable of running our databases or programs.
Storage device means any device that is capable of storing our
databases or programs in digital form.
There are a few rules that you must adhere to, and these are
listed below.
We define pre-written software as programs or databases
that you did not commission us or ask us to write for you,
and they are therefore NOT tailored to your specific
requirements. This definition also includes if we have
carried out any programming for you that is based on one of
our pre-written databases or programs but the majority of
the functionality of the database or program is still as it
was before we made the changes.
You do not own this software. The payment you made to us
for it only provides you with a licence to use it. In the
case of a database, you will be given a password or
passwords in order that you can use the software, but you
will not be given the system password, and therefore you
cannot make changes to any of the forms, reports, or macros
within the database. You may create tables, queries, forms,
reports and macros, but you cannot add any VBA code either
as code-behind-forms or code-behind-reports, or as
standalone VBA modules or classes.
We do not mind how many computers the program is
installed on, nor how many backup copies you have. However,
you must not use the software simultaneously on more
computers than you have licences for, i.e. if you have paid
for two licences then you may have the software running on
two computers at the same time. If you only have one
licence but you want to install and use this software for
example on a home desktop, a laptop and a computer in your
workplace, you may do so as long as you and/or others are
not using the software on more than one computer at the same
time.
Unless the licence states it, this software is not
designed to be used across a network system, regardless of
how many licences you have bought. Also, we will not be held
responsible for any loss of data, damage to computer system,
or loss of earnings or time as a result of any hardware or
software failure.
You may not copy this software and give it away to
anyone, nor sell it to anyone, unless you delete all the
copies of the software on all the computer storage devices
that you use or have access to (whether you own them or
not), in such a way that the software cannot be undeleted
and/or installed/used again by you. In addition, you must
supply all installation disks/downloads and all supporting
files and the licence, and instructions if applicable.
You may not reverse engineer, disassemble or change the
software in any way whatsoever, with the exception of adding
to it as stated above. If you would like the software to
behave in a different way, or you would like it to have
additional features or functions, we may at our sole
discretion look at your proposals or ideas. However, we make
no promises either now or in the future that any of your
proposals or ideas will appear in any future releases or
updates to the software. If they do, you will be given the
credit for them within the software in such a way that other
users can see your name, or in the accompanying instructions/
documentation (unless you ask us not to do this).
If there is a dispute between you and us, English Law
and English Courts will be the only jurisdiction that
applies, and all correspondence will be in the English
language, whether written or oral or by any other means. If
any part of this EULA is successfully challenged in an
English Court, it does not mean that the whole of this EULA
is invalid. The judgment will apply only in the narrowest
sense permissible and the remainder of this EULA will still
be legally binding.
